On July 1, 2014, Probate Court was transferred from Franklin County General Sessions Court to Chancery Court. Changes have been made to the probate process. We hope these changes will make Probate more accessible and convenient to the Attorneys and families. The changes are as follows:
- Appointments will need to be made to probate an estate, unless otherwise approved by the Clerk and Master.
- Documents must be approved by the Clerk and Master before the scheduled appointment.
- Please submit proposed documents to the Clerk and Master at least 2 days prior to the scheduled appointment.
- We will accommodate everyone by being very flexible with dates and times.
- Attorneys may mail probate documents in lieu of an in-person appearance. Please include a self-addressed, stamped envelope for documents and letters to be returned. The Clerk and Master will not mail documents back otherwise.
- We will not make appointments on days Chancellor Willis is holding Court
- An Information sheet is provided on this Website under “Probate Forms” to be completed and returned to us prior to your appointment. (This will avoid the need to prepare forms after you arrive)

Please remind your clients that cost for opening estate is $374.50 plus $120.00 for Notice to Creditors- Payable to The Herald Chronicle.
We take cash, check , money orders debit and credit cards (company adds 3%).
CREDITORS:
All claims must be stamped certified and filed in triplicate.

SMALL ESTATES:
On April 28, 2023 the state legislature passed a new law on the issuing of Affidavits for Small Estates. At this time we do not have forms or paperwork for Po Se’ litigants.
